APPEALS
Description
The Constitution gives an individual the right to appeal any conviction or sentence received. Many convictions and/or sentences are reversed on appeal; however, you may have limited time in which to file an appeal.
Criminal Appeals
Many individuals are wrongly convicted because judges, prosecutors, and defense lawyers make mistakes.
Some judges can make errors by doing the following:
- allowing evidence against a defendant
- excluding evidence favorable to a defendant
Some prosecutors may do the following:
- make unfair statements against defendants
- prevent favorable evidence from being admitted
- otherwise prejudice a defendant
Some defense attorneys can do the following:
- improperly investigate a case
- fail to prepare for a case
- have insufficient knowledge of the law
- fail to make proper objections, fail to use investigators
- fail to call witnesses on a defendant's behalf
One or more mistakes by a judge, prosecutor, or defense attorney may deprive a defendant of a fair trial and result in an unjust conviction and prison time. The experienced appeal lawyers of Helmer, Paul, Conley & Kasselman, P.A. can maximize the chances of a successful appeal by reviewing the case for errors that could lead to a reversal of the conviction and a new trial.
In some instances, we may convince the court to release the defendant from prison on bail while the appeal is pending.

Frequently Asked Questions

- 2. If I win an appeal, will the case be dismissed?
It depends on the reason the case was reversed. There could be a dismissal or a new trial.
- 3. Should the firm that represented me at trial handle my appeal?
Generally, no, since you should hire an outside lawyer who will review the trial records for all mistakes, including those made by the original trial attorney.
- 4. How much will my appeal cost?
It depends. The length of the trial and complexity of the issues are important factors in determining fees.
- 5. Do I have to pay for an initial consultation?
Unlike other firms, we do not charge for initial consultations in any criminal cases.
